Karnataka Medical Council is judicial platform to provide justice in cases of wilful medical negligence and for deficiencies in medical services to the patients and/or consumers, the aggrieved parties and/or the dependants of the deceased in such medical negligence can move KMC for Justice.
- • KMC maintains Code and Conduct of the Medical Practitioners Registered under this Act and take action against the erring doctors.
- • KMC ensures regular up-gradation of knowledge about recent advances , techniques of practice and to impart the same to the needy in the Society.
- • KMC maintains the Medical Registers and updating the same.
Medical negligence is also punishable under various laws such as torts, IPC, Indian Contracts Act, Consumer Protection Act, etc., It can be defined as wilful misconduct by a medical practitioner or doctor in which medical practitioner or doctor by not providing enough care resulting in breach of their duties and in the result harming the patients by injuries/permanent disabilities/causing death which are their consumers Introduction
Medical Negligence basically is the misconduct by a medical professional who is certified and deemed to be an expert and patient getting treated under any such doctor at the least expects the doctor to be careful while performing his duties. Medical negligence has caused many deaths as well as adverse results to the patient’s health.
The Hospitals can also be held responsible for their various acts of negligence in services in cases of medical negligence along with or without erring doctors as the case may be.
